VE T\u0130C. LTD. \u015eT\u0130.<\/strong> i\u015fyerinde 4857 say\u0131l\u0131 \u0130\u015f Kanununa tabi olarak \u00e7al\u0131\u015fan t\u00fcm personel hakk\u0131nda uygulan\u0131r.<\/p>\n<p><strong>Dayanak<\/strong><\/p>\n<p>Madde 3 \u2013\u00a0Bu y\u00f6netmelik dayana\u011f\u0131n\u0131 4857 say\u0131l\u0131 \u0130\u015f Kanunundan almaktad\u0131r.<\/p>\n<p><strong>Tan\u0131mlar<\/strong><\/p>\n<p>Madde 4 \u2013\u00a0Bu y\u00f6netmelikte ge\u00e7en;<\/p>\n<ol>\n<li>\u0130\u015fveren: <strong>DETEKS MODA TEKST\u0130L SAN. LTD. \u015eT\u0130.<\/strong><\/li>\n<li>\u0130\u015fyeri: \u0130\u015fveren ba\u011fl\u0131 olarak i\u015flerin y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc a\u00e7\u0131k ve kapal\u0131 alanlar\u0131<\/li>\n<li>\u0130\u015f\u00e7i: \u0130\u015fverene ba\u011fl\u0131 olarak \u00e7al\u0131\u015fan ve 4857 say\u0131l\u0131 \u0130\u015f Kanunu kapsam\u0131nda bulunan personeli<\/li>\n<li>Disiplin cezas\u0131 vermeye yetkili makam: \u0130\u015f\u00e7inin amiri durumunda bulunan ve i\u015f\u00e7i hakk\u0131nda uygulanacak disiplin cezas\u0131na karar verme yetkisine sahip olan g\u00f6revliyi\/makam\u0131<\/li>\n<\/ol>\n<p>ifade eder.<\/p>\n<p><strong>\u0130K\u0130NC\u0130 B\u00d6L\u00dcM: Disiplin cezalar\u0131<\/strong><\/p>\n<p><strong>Disiplin Cezalar\u0131<\/strong><\/p>\n<p>Madde 5 \u2013\u00a0\u0130\u015f\u00e7iler hakk\u0131nda uygulanacak disiplin cezalar\u0131 \u015funlard\u0131r:<\/p>\n<ol>\n<li>Uyar\u0131: \u0130\u015f\u00e7iye, g\u00f6revinin yerine getirilmesinde ve davran\u0131\u015flar\u0131nda daha dikkatli olmas\u0131 gerekti\u011finin yaz\u0131l\u0131 olarak bildirilmesidir.<\/li>\n<li>K\u0131nama: \u0130\u015f\u00e7iye, g\u00f6revinin yerine getirilmesinde ve davran\u0131\u015flar\u0131nda kusurlu oldu\u011funun yaz\u0131 ile bildirilmesidir.<\/li>\n<li>Hakl\u0131 nedenle fesih: \u0130\u015f\u00e7inin 4857 say\u0131l\u0131 \u0130\u015f Kanununun 25inci maddesi kapsam\u0131ndaki fiili nedeniyle derhal ve tazminats\u0131z olarak i\u015ften \u00e7\u0131kar\u0131lmas\u0131d\u0131r.<\/li>\n<\/ol>\n<p>Madde 6 \u2013\u00a0Uyar\u0131 cezas\u0131 a\u015fa\u011f\u0131daki hallerde uygulan\u0131r:<\/p>\n<ol>\n<li>Mazeretsiz olarak; mesai ba\u015flang\u0131\u00e7 saatinden sonraki bir saat i\u00e7inde i\u015fe gelmemi\u015f olmak veya mesai bitiminden \u00f6nceki bir saat i\u00e7inde i\u015ften \u00e7\u0131km\u0131\u015f olmak<\/li>\n<li>Verilen g\u00f6revlerin tam ve zaman\u0131nda yap\u0131lmas\u0131nda, ara\u00e7 ve gere\u00e7lerin kullan\u0131lmas\u0131nda dikkatsizlik ve \u00f6zensizlik g\u00f6stermek<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n<p>Madde 7 \u2013\u00a0K\u0131nama cezas\u0131 a\u015fa\u011f\u0131daki hallerde uygulan\u0131r:<\/p>\n<ol>\n<li>Mazeretsiz olarak; mesai ba\u015flang\u0131\u00e7 saatinden bir saat ge\u00e7tikten sonra i\u015fe gelmi\u015f olmak veya mesai bitimine bir saatten \u00e7ok s\u00fcre kalm\u0131\u015fken i\u015ften \u00e7\u0131kmak<\/li>\n<li>Verilen g\u00f6revlerin tam ve zaman\u0131nda yap\u0131lmas\u0131nda, ara\u00e7 ve gere\u00e7lerin kullan\u0131lmas\u0131nda kusurlu davranmak<\/li>\n<li>Uyar\u0131 cezas\u0131 gerektiren bir fiilin ikinci kez i\u015flenmi\u015f olmas\u0131<\/li>\n<\/ol>\n<p>Madde 8 \u2013\u00a0Hakl\u0131 nedenle fesih cezas\u0131 a\u015fa\u011f\u0131daki haller uygulan\u0131r<\/p>\n<ol>\n<li>\u0130\u015f s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131 s\u0131rada bu s\u00f6zle\u015fmenin esasl\u0131 noktalar\u0131ndan biri i\u00e7in gerekli vas\u0131flar veya \u015fartlar kendisinde bulunmad\u0131\u011f\u0131 halde bunlar\u0131n kendisinde bulundu\u011funu ileri s\u00fcrerek, yahut ger\u00e7e\u011fe uygun olmayan bilgiler veya s\u00f6zler s\u00f6yleyerek i\u015f\u00e7inin i\u015fvereni yan\u0131ltmas\u0131.<\/li>\n<li>\u0130\u015f\u00e7inin, i\u015fveren yahut bunlar\u0131n aile \u00fcyelerinden birinin \u015feref ve namusuna dokunacak s\u00f6zler sarfetmesi veya davran\u0131\u015flarda bulunmas\u0131, yahut i\u015fveren hakk\u0131nda \u015feref ve haysiyet k\u0131r\u0131c\u0131 as\u0131ls\u0131z ihbar ve isnadlarda bulunmas\u0131.<\/li>\n<li>\u0130\u015f\u00e7inin i\u015fverenin ba\u015fka bir i\u015f\u00e7isine cinsel tacizde bulunmas\u0131.<\/li>\n<li>\u0130\u015f\u00e7inin i\u015fverene yahut onun ailesi \u00fcyelerinden birine yahut i\u015fverenin ba\u015fka i\u015f\u00e7isine sata\u015fmas\u0131 , i\u015fyerine sarho\u015f yahut uyu\u015fturucu madde alm\u0131\u015f olarak gelmesi ya da i\u015fyerinde bu maddeleri kullanmas\u0131.<\/li>\n<li>\u0130\u015f\u00e7inin, i\u015fverenin g\u00fcvenini k\u00f6t\u00fcye kullanmak, h\u0131rs\u0131zl\u0131k yapmak, i\u015fverenin meslek s\u0131rlar\u0131n\u0131 ortaya atmak gibi do\u011fruluk ve ba\u011fl\u0131l\u0131\u011fa uymayan davran\u0131\u015flarda bulunmas\u0131.<\/li>\n<li>\u0130\u015f\u00e7inin, i\u015fyerinde, yedi g\u00fcnden fazla hapisle cezaland\u0131r\u0131lan ve cezas\u0131 ertelenmeyen bir su\u00e7 i\u015flemesi.<\/li>\n<li>\u0130\u015f\u00e7inin i\u015fverenden izin almaks\u0131z\u0131n veya hakl\u0131 bir sebebe dayanmaks\u0131z\u0131n ard\u0131 ard\u0131na 2 i\u015f g\u00fcn\u00fc veya bir ay i\u00e7inde 2 defa herhangi bir tatil g\u00fcn\u00fcnden sonraki i\u015f g\u00fcn\u00fc, yahut bir ayda 3 i\u015f g\u00fcn\u00fc i\u015fine devam etmemesi.<\/li>\n<li>\u0130\u015f\u00e7inin yapmakla \u00f6devli bulundu\u011fu g\u00f6revleri kendisine hat\u0131rlat\u0131ld\u0131\u011f\u0131 halde yapmamakta \u0131srar etmesi.<\/li>\n<\/ol>\n<p><strong>Di\u011fer fiiller ve cezalar\u0131<\/strong><\/p>\n<p>Madde 9 \u2013\u00a0Bu y\u00f6netmelikte a\u00e7\u0131k\u00e7a say\u0131lmayan bir fiilin meydana gelmesi durumunda; i\u015f\u00e7inin bu fiilinin kar\u015f\u0131l\u0131\u011f\u0131nda, fiile en yak\u0131n ve benzer olan fiilin gerektirdi\u011fi disiplin cezas\u0131 uygulan\u0131r. Ayr\u0131ca 4857 say\u0131l\u0131 \u0130\u015f Kanununun h\u00fck\u00fcmleri g\u00f6z \u00f6n\u00fcne al\u0131narak da i\u015flem yap\u0131labilir.<\/p>\n<p><strong>\u00dc\u00c7\u00dcNC\u00dc B\u00d6L\u00dcM: S\u00fcreler, Savunma, \u0130tiraz ve Zamana\u015f\u0131m\u0131<\/strong><\/p>\n<p><strong>S\u00fcreler<\/strong><\/p>\n<p>Madde 10 \u2013\u00a0Bu y\u00f6netmelikte ge\u00e7en disiplin cezalar\u0131; fiilin i\u015f\u00e7i taraf\u0131ndan ger\u00e7ekle\u015ftirildi\u011finin, cezay\u0131 vermeye yetkili makamca \u00f6\u011frenilmesinden itibaren 6 i\u015f g\u00fcn\u00fc i\u00e7inde verilir.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p><strong>Savunma<\/strong><\/p>\n<p>Madde 11 \u2013\u00a0Bu y\u00f6netmelikte belirtilen disiplin cezalar\u0131n\u0131n uygulanmas\u0131ndan \u00f6nce i\u015f\u00e7inin savunmas\u0131n\u0131n al\u0131nmas\u0131 esast\u0131r. Fiilin ger\u00e7ekle\u015fti\u011finin, disiplin cezas\u0131n\u0131 vermeye yetkili makamca \u00f6\u011frenilmesini takip eden i\u015f g\u00fcn\u00fc savunma talep edilir ve i\u015f\u00e7iye savunma i\u00e7in 1 i\u015f g\u00fcn\u00fc s\u00fcre verilir.<\/p>\n<p>Yukar\u0131daki f\u0131krada yer alan s\u00fcreler kesin olmay\u0131p gerekti\u011finde bu s\u00fcreler de\u011fi\u015ftirilebilmekle birlikte t\u00fcm i\u015flemlerin sonunda 6 i\u015f g\u00fcn\u00fcnde karar verilmesi esast\u0131r.<\/p>\n<p>A\u015fa\u011f\u0131daki hallerde i\u015f\u00e7inin savunmas\u0131n\u0131n al\u0131nmas\u0131na gerek yoktur:<\/p>\n<ol>\n<li>\u0130\u015f\u00e7inin, i\u015fyerinde, yedi g\u00fcnden fazla hapisle cezaland\u0131r\u0131lan ve cezas\u0131 ertelenmeyen bir su\u00e7 i\u015flemesi<\/li>\n<li>\u0130\u015f\u00e7inin g\u00f6zalt\u0131na al\u0131nmas\u0131 veya tutuklanmas\u0131 halinde devams\u0131zl\u0131\u011f\u0131n 17 nci maddedeki bildirim s\u00fcresini a\u015fmas\u0131<\/li>\n<li>\u0130\u015f\u00e7inin tutuldu\u011fu hastal\u0131\u011f\u0131n tedavi edilemeyecek nitelikte oldu\u011fu ve i\u015fyerinde \u00e7al\u0131\u015fmas\u0131nda sak\u0131nca bulundu\u011funun Sa\u011fl\u0131k Kurulunca saptanmas\u0131 durumunda<\/li>\n<li>Halin gere\u011fi olarak, savunma al\u0131nmas\u0131na yetkili makamlarca a\u00e7\u0131k\u00e7a gerek g\u00f6r\u00fclmemesi<\/li>\n<\/ol>\n<p><strong>\u0130tiraz<\/strong><\/p>\n<p>Madde 12 \u2013\u00a0Hakk\u0131nda disiplin cezas\u0131 uygulanan i\u015f\u00e7i bu cezaya 3 g\u00fcn i\u00e7inde itiraz edebilir. \u0130tiraz\u0131n yaz\u0131l\u0131 olarak yap\u0131lmas\u0131 gerekir. \u0130\u015f\u00e7inin itiraz\u0131n\u0131n, disiplin cezas\u0131n\u0131 veren makama ula\u015fmas\u0131ndan itibaren 3 g\u00fcn i\u00e7inde i\u015f\u00e7iye cevap verilir. Bu y\u00f6netmelikte yer alan disiplin cezalar\u0131ndan olan hakl\u0131 nedenle fesih cezas\u0131na itiraz edilmesi ise m\u00fcmk\u00fcn de\u011fildir.<\/p>\n<p><strong>Zamana\u015f\u0131m\u0131<\/strong><\/p>\n<p>Madde 13 \u2013\u00a0\u00a0Bu y\u00f6netmeli\u011fin 9uncu maddesinde say\u0131lan hakl\u0131 nedenle derhal fesih cezas\u0131n\u0131 gerektiren bir fiilin ger\u00e7ekle\u015fmesinden itibaren bir y\u0131l ge\u00e7tikten sonra bu fiil hakk\u0131nda disiplin cezas\u0131 uygulanamaz. Ancak i\u015f\u00e7inin olayda maddi \u00e7\u0131kar sa\u011flamas\u0131 halinde bir y\u0131ll\u0131k zamana\u015f\u0131m\u0131 s\u00fcresi ge\u00e7erli de\u011fildir.<\/p>\n<p><strong>D\u00d6RD\u00dcNC\u00dc B\u00d6L\u00dcM: \u00c7e\u015fitli H\u00fck\u00fcmler ve Y\u00fcr\u00fcrl\u00fck<\/strong><\/p>\n<p><strong>\u00c7e\u015fitli H\u00fck\u00fcmler<\/strong><\/p>\n<p>Madde 14 \u2013\u00a0Bu y\u00f6netmelikte yer almasa bile, \u0130\u015f Kanununun y\u00f6netim hakk\u0131 kapsam\u0131nda i\u015fverene verdi\u011fi yetkileri kullanmak i\u015fverenin takdirindedir. 4857 say\u0131l\u0131 \u0130\u015f Kanununun i\u015fverene a\u00e7\u0131k\u00e7a verdi\u011fi bir yetkinin, bu y\u00f6netmelikte yer almad\u0131\u011f\u0131 gerek\u00e7esiyle kullan\u0131lamayaca\u011f\u0131 iddia edilemez.<\/p>\n<p>Madde 15\u2013\u00a0Bu y\u00f6netmelik i\u015fyerinde uygun bir yerde ilan edilir ve i\u015f\u00e7ilere duyurulur. Y\u00f6netmeli\u011fin y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi tarihten itibaren, \u00e7al\u0131\u015fmakta olan ve i\u015fe giren her i\u015f\u00e7i bu y\u00f6netmelik h\u00fck\u00fcmlerini pe\u015finen kabul etmi\u015f say\u0131l\u0131r.<\/p>\n<p><strong>Y\u00fcr\u00fcrl\u00fck<\/strong><\/p>\n<p>Madde 16 \u2013\u00a0Bu y\u00f6netmelik 01\/01\/2018 tarihinden itibaren
